  • For Homeowner, Townhome and Condominium Associations
    • General Counsel - Our firm serves as legal counsel for your community association. We assist the board of directors in providing legal guidance to assist with daily operations of the association. Additionally our firm serves as the registered agent for the association, submits the annual report for the corporation and maintains a record of all board meeting minutes provided to our office.
    • One Quick Question Service - Our firm will answer quick questions for the board of directors at no charge, based upon payment of our annual subscription fee. This is by far one of our most popular services, and allows board members to ask questions without concern about increasing costs.
    • Delinquent Dues Collection - Our firm will collect your association's delinquent dues at little or no cost to the association. In the last five years, we have collected over 1.2 million dollars in delinquent dues to our associations.
    • Legal Opinion Letters - Our attorneys can research and prepare a written legal opinion in response to one or more detailed questions from the board of directors. These letters provide valuable assurance to the board that they are operating within Tennessee law as well as the boundaries of the governing documents of the association. Often we also include practical suggestions on how to resolve the situation to go beyond mere legal advice to leverage our wealth of experience with community associations to assist your community.
    • Vendor Contract Review - We will review and advise you on any language in your vendor contracts that is not favorable to the association. Often these small changes can save substantial time and expense in the event the relationship with the vendor is terminated.
    • Covenant Enforcement - Our firm partners with our association clients to help the board of directors ensure that the covenants are enforced. We write letters to owners and prepare notices of noncompliance for recording and file lawsuits to enforce covenants. In circumstances where an exception is legally valid, we prepare and file variances for our clients.
    • Restrictive Covenant Drafting and Amendments - Our firm assists developers with establishing restrictive covenants to protect the property values and the integrity of the community. We also assist established neighborhoods make modifications to their existing covenants.
    • Dues Billing and Accounting Service - For those communities who are not professionally managed, we offer a subscription service that transfers the responsibility for dues invoicing and accounting to our firm. Our office maintains owner information, submits dues invoices and reports to the board on a monthly basis. This service is performed on a fixed fee subscription basis as an additional means of controlling costs.
  • For parties with a legal dispute to resolve
    • Mediation Services - Mr. Miller is listed by the Supreme Court of Tennessee as a Rule 31 Civil and Family Mediator. Mr. Miller has the training and experience to assist parties in resolving any type of dispute without the time and expense of a formal trial. Mediation can often be scheduled within two weeks, and many matters are resolved in one session. The process is non-binding, but if a dispute can be resolved, it provides an environment to work out a resolution in a confidential setting for a fraction of the time and expense associated with a trial.
    • Arbitration Services - Mr. Miller is listed by the Supreme Court of Tennessee as a Rule 31 Civil and Family Neutral. Mr. Miller can serve as an arbitrator, in which case he hears from both parties and makes a binding decision in the matter. Arbitration can often be scheduled within two weeks, and many matters are resolved as quickly as practical. The process is binding, and offers a swift resolution to a dispute without the normal delays involved in litigation.

These affordable plans start as low as $150.
    • Trust Based Estate Plans These comprehensive plans provide advanced protection. They include a Revocable Living Trust, a Last Will and Testament, an Advanced Directive for Healthcare Decisions, and a Durable Power of Attorney for financial management in the event of a temporary disability. These plans avoid probate entirely, provide superior estate tax protection, and give you tremendous flexibility in stating and ensuring your wishes are carried out. They also provide extensive disability planning, and can be used to provide for many generations, if that is your desire.
    • Irrevocable Trust Based Estate Plans These advanced plans also include an irrevocable trust to hold assets such as life insurance policies. The benefit of such an irrevocable trust is that if administered properly, it can exclude the value of the asset from estate tax, regardless of the size of the estate. These plans also include all of the features of the Trust Based Estate Plans.
    • Guardianship Plans As an add-on to any of our estate plans, we can work with you to prepare a guardianship plan for the care of your children. This would be used in the event of a temporary or permanent disability or at your passing. These plans deal with more than just financial resources, and document the guiding principles that are so important to you.
